SUMMARY:Animal Tracking Workshop
DESCRIPTION:Join us in learning to notice and identify the tracks & other signs of wildlife to help protect and monitor our watersheds!\nTracking is an important method for monitoring the impacts of the work that is starting to clear for the reroute of line 5. We are much more likely to see the tracks and sign of an animal who depends on ecosystems and waterways crossed by the reroute than we are to see the actual animal. This gathering is an opportunity get comfortable noticing and documenting tracks and can help prepare folks to monitor reroute activities and submit pictures of tracks for expert support in identifying the tracks. \nThe event will be held in the trails around the Northern Great Lakes Visitor Center.

At the last Executive Committee meeting there was discussion regarding an agreement with Wisconsin Counties Association (WCA) and Enbridge for the pipeline project reimbursement expenses. As additional public safety expenses may be incurred for protective equipment and response in Bayfield and Ashland Counties\, Enbridge has established an escrow account administered by WCA to reimburse local entities for associated extraordinary law enforcement services. \nExec meeting highlights:\nAt the Exec meeting several motions were made:\n• A motion to forward the existing WCA/ Enbridge agreement to the board failed by a 2-4 vote.\n• A motion to seek no reimbursement from WCA/Enbridge failed 0-6.\nA recommendation to investigate an alternative reimbursement process with a general\npolicy addressing:\n• Eligible costs\n• Board approval\n• Affirmation of constitutional protections\n• Compliance with open records laws \nAt the Exec meeting\, One member preferred not to go through WCA. Three members preferred WCA. Two members wanted to see options and addressing of the “conflict of interest” concern. Corporation Counsel was directed to prepare possible options. \nAttached in the packet are four reimbursement options for consideration. The first two are agreements\, the second two are ordinances. The WCA/Enbridge/Bayfield County\nagreement has received WCA/Enbridge approval. All four of these options were sent to WCA/Enbridge for their review last Thursday\, March 26. \n\nModified WCA / Enbridge Agreement: This is similar to previous versions with several revisions to address Supervisor concerns. It also includes specific mention of dispatch/communications related expenses with interoperability and the\npotential need for adding more dispatchers. Approved by WCA/ENBRIDGE\nPublic Safety Expense Grant and Reimbursement Agreement: This is a direct contract between Enbridge and Bayfield County. This agreement mirrors items in the WCA agreement but does not involve WCA. Not yet approved by Enbridge.\nCommunity Events Ordinance: This utilizes verbiage directly from the La Crosse Community Events ordinance\, allowing for pre-payment of expected event costs. It is a more general application that involves the granting of a permit. This option is included as an example and would require additional work.\nOrdinance Establishing Cost Recovery For Extraordinary Public Safety Services. This document combines elements of the La Crosse ordinance with best practices for establishing and operating a neutral cost recovery framework for events\, projects\, and activities that require extraordinary public safety services. This is a cost recovery type agreement.\n\nAgreements #1 and 2 specify that nothing in this Agreement shall require any County or Sheriff to provide any services beyond that required under Wisconsin Law. Both of the ordinances would benefit from additional review and final adjustments\, attachments\, etc.

SUMMARY:Line 5 Reroute Hearing
DESCRIPTION:Pack the courtrooms to attend the Line 5 Reroute hearing!\nThis hearing is in response to the Bad River Band’s appeal of the WDNR permit for the re-route of Line 5. It will address the Band’s request for a stay on construction while the court case is open. The Bad River Band is continuing to object to the WDNR permitting of the LIne 5 reroute and the case is now being heard by Bayfield County’s Judge Anderson.\nThere is no public comment opportunity during these proceedings. Instead lawyers representing Bad River and lawyers from the WDNR and Enbridge will be presenting their cases to Judge Anderson for a decision. \nLocation: Bayfield County Courthouse with live streaming to the Iron County Courthouse. No virtual option\nPlease see the flyer for more details. \nDetails on the rules set by Judge Anderson regarding public access and media access: \n“Except for designated media representatives\, the general public will be prohibited from operating any electronic devices..”    ” Representatives of the media who wish to take still photographs of the proceedings must have permission from the Court prior to the hearing. “.. “No person\, including media representative\, shall be allowed to record by video or audio” \nAll media requests should be submitted more than 72 hours prior to the hearing. Iron County media coordinator:\nMichael Baldwin\, KBJR\n246 S Lake Ave\nDuluth\, MN 55802\n(218)481-6212\nmbaldwin@kbir6.com \nBoth the Bayfield and Iron County courtrooms will be open to the public during any hearing at which Judge Anderson will appear remotely. Seating is limited in both courtrooms and the safe room capacity in each will not be exceeded. Due to the number of attorneys and parties and the need for a more robust video conference and presentation system than currently exists in the Iron County courtroom\, in- person appearances by lawyers and parties will be in the Bayfield County courtroom. \n\nWith that\, there is an opportunity for folks who are interested in taking on an independent media role to get a press pass. If you’re interested\, email southshorewaterprotectors@proton.me \nAs defined by law (Constitution and Bill of Rights)\, journalists with an official press pass have additional protection while working at actions. The designation also provides for privacy related to their “source” of information. It is time a Water Protectors’ News Team be established. The first step is to identify a small diverse group interested in obtaining an official Press Pass. We have identified a legally registered news outlet willing to issue the pass. If you are a good writer\, have the ability to move fast to an action/event\, critically observe/document and are skilled at using the wide array of platforms for getting news out\, you are needed!\n\n\n\n\n

SUMMARY:RESCHEDULED Bayfield County Board of Supervisors Meeting
DESCRIPTION:Bayfield County Board of Supervisors is meeting regarding the new contract discussing money for the sheriff (as the alternative to the WCA/Enbridge contract with the Sheriff’s office). \nPublic Comment Needed! \nCalendar link: https://www.bayfieldcounty.wi.gov/Calendar.aspx?EID=10139&month=4&year=2026&day=20&calType=0\nVirtual meeting: https://teams.microsoft.com/meet/25291229446963?p=paAZRC7CkAIEBSvj\nAgenda link: https://www.bayfieldcounty.wi.gov/AgendaCenter/ViewFile/Agenda/_04212026-3303 \nWe are looking at Agenda item number 16. Discussion regarding Public Safety Cost Revory Ordinance \nPrevious meeting recording: https://www.youtube.com/watch?v=VE6Yvr8CoTU\nDuring the last meeting\, the Bayfield Board of Supervisors denied all Law Enforcement agreements with Enbridge. Instead\, they decided to move forward towards creating an Ordinance so that everything was/is transparent when it comes to the utilization of Law Enforcement by private entities. Bayfield also turned down Enbridge paying for Law Enforcement safety equipment and decided the county should pay for protective gear themselves. Law Enforcement shows old equipment as their sales pitch.

Ashland and Iron County both passed agreements in February. There’s an effort in Ashland to have a re-vote. Bayfield County is considering a modified version after voting no in February. There is a conflict of interest with teh Sheriff Departments serving to protect the Bad River Band and then having a cooperative agreement with Enbridge. The priority needs to be serving and building trust within our local communities\, not protecting a Canadian company.

Bad River is requesting healing between neighbors yet Ashland appears to be doing the opposite by taking action in standing with Enbridge instead of with Bad River.

SUMMARY:Virtual Public Hearing - 4 Water Body Crossing DNR Permits
DESCRIPTION:Informational Hearing Time/Accessing:  \nThe public informational hearing is scheduled for Wednesday\, April 22\, 2026 beginning promptly at 12:00 PM Central Time (US and Canada). The hearing will be held until 3:00pm Central Time or until the last oral comments are received\, whichever occurs first. \nThe hearing will be held virtually via the Zoom Remote Conferencing Platform\, which is accessible by computer or phone. Please use the following link to access the informational hearing:\nhttps://us02web.zoom.us/j/84534209103?pwd=THCQwD41CbUjubbIXFrwJaNAoyTydH.1\nYou can also join by visiting Zoom’s website https://zoom.us/join  or calling +1 646 931 3860 (US) and entering the Meeting ID 845 3420 9103 and Passcode 811602. \nAbout the Hearing:  \nPublic Notification Download – https://permits.dnr.wi.gov/water/SitePages/DocSetPNView.aspx?DocSet=WP-IP-NO-2025-2-X11-24T14-27-22 \nThe Department has scheduled a public informational hearing for the four projects for Wednesday\, Aprill 22nd at 12pm Central Time (US and Canada). The public informational hearing will be held virtually via the Zoom Remote Conferencing Platform\, which is accessible by computer or phone. The public informational hearing provides an opportunity for you and the Department to gather additional facts to help gauge the possible environmental impacts of your proposed projects. The hearing is informational only. Department staff will manage the hearing agenda according to set procedures to allow all who attend a chance to be heard and to gather as much factual information as possible. The applicant (or applicant representative) is responsible for preparing and presenting information on the proposed projects\, as it relates to their waterway permit applications. \nThe enclosed document is a “Notice of Public Hearing” for your projects. The Department will publish the notice on our website today. The period to submit written public comments began on March 10\, 2026 (please reference your Notice of Pending Application letters) and will end 10 days after the date the public informational hearing is completed.\n“All who attend a chance to be heard and to gather as much factual information as possible.” \nBackground: One of our arguments in the contested case hearing was that Enbridge was not eligible for permits because they do not own the land at some stream crossings where they propose work\, and land ownership is a requirement. This fall Enbridge co-submitted new applications with the landowners they have easements with for the four locations in question. The public comment period on those permits is now open and it’s a good opportunity to show continued opposition.  Here’s the action page Sierra Club has set up. \n\nUnnamed Tributary to Brunsweiler River (Docket Number IP-NO-2025-2-N03672) –  WP-IP-NO-2025-2-X11-24T14-27-22\nBeartrap Creek (Docket Number IP-NO-2025-2-N03673) –  WP-IP-NO-2025-2-X11-24T14-29-11\nLittle Beartrap Creek (Docket Number IP-NO-2025-2-03679) –  WP-IP-NO-2025-2-X11-24T14-30-45\nBay City Creek (Docket Number IP-NO-2025-2-03680) –  WP-IP-NO-2025-2-X11-24T14-32-15\n\nIf you would like to know more about this project or would like to see the application and plans\, please visit the Department’s permit tracking website and search by Permit Docket Number (listed below): https://permits.dnr.wi.gov/water/SitePages/Permit%20Search.aspx \nSubmit Written Comment:\nAny person may submit written comments by emailing macaulay.haller@wisconsin.gov \, by leaving a voice message at (608) 347-0240\, or writing to Macaulay Haller\, 101 S. Webster St.\, Madison\, WI\, 53707-7921 by mail. Comments should include the docket number (listed below) or applicant name and should relate to whether the project meets the legal standards listed above.
