SUMMARY:Oral hearing on lifting the "stay" on the 4 Contested Stream Crossings
DESCRIPTION:Judge John Anderson is scheduled to hear arguments at 1 p.m. Aug. 13 on whether Enbridge can resume construction at the previously “stayed\,” four contested stream crossings on the Line 5 pipeline reroute. He is presiding over an Appeal of the Line 5 reroute WIDNR permit acceptance\, brought up to Iron County from the lower court administrative case accepting the permit. Judge Anderson had previously issued a “stay” on May 15 that halted work at the crossings of Beartrap Creek\, Bay City Creek\, Little Beartrap Creek\, and an unnamed tributary of the Brunsweiler River. Four crossings where the Bad River Band of Lake Superior Chippewa and environmental groups say Enbridge does not own the required streamside land. \nThe Public may attend In Person Only at either 117 E 5th St\, Washburn\, WI 54891 or 300 Taconite St #101\, Hurley\, WI 54534 courthouses. The hearing is expected to only be about an hour long. Judge Anderson will be present in the Washburn Courthouse. \nPending Permit Information: \nUnnamed Tributary to Brunsweiler River (Docket Number IP-NO-2025-2-N03672) – https://permits.dnr.wi.gov/water/SitePages/DocSetView.aspx?DocSet=WP-IP-NO-2025-2-X11-24T14-27-22&Loc=undefined \nBeartrap Creek (Docket Number IP-NO-2025-2-N03673) –https://permits.dnr.wi.gov/water/SitePages/DocSetView.aspx?DocSet=WP-IP-NO-2025-2-X11-24T14-29-11&Loc=undefined \nLittle Beartrap Creek (Docket Number IP-NO-2025-2-03679) – https://permits.dnr.wi.gov/water/SitePages/DocSetView.aspx?DocSet=WP-IP-NO-2025-2-X11-24T14-30-45&Loc=undefined \nBay City Creek (Docket Number IP-NO-2025-2-03680) – https://permits.dnr.wi.gov/water/SitePages/DocSetView.aspx?DocSet=WP-IP-NO-2025-2-X11-24T14-32-15&Loc=undefined \nFor more info see: https://www.apg-wi.com/ashland_daily_press/news/local/judge-to-weigh-whether-line-5-construction-can-resume-at-four-stream-crossings/article_b2ffc4ec-aa4f-45dc-888e-5a18b2197cc0.html \n  \n
